1. Who we are

B2B Forms is a service operated by Stephen Roberts, trading as Giftings. These Terms of Service are a legal agreement between you and us, governing your use of the B2B Forms service.

2. Agreement to these terms

By creating an account or using B2B Forms, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the service.

You must be at least 18 years old and legally capable of entering into a binding agreement to use B2B Forms.

3. The service

B2B Forms helps you create, publish, and manage intent-first forms for B2B and C2C use cases. The service includes:

  • AI-assisted form generation from a plain-language business description.
  • Storage and management of your forms within your account.
  • Publishing of forms at a unique public URL, and embedding of forms on your own website via an iframe.
  • Collection, storage, and export of responses submitted through your published forms.
  • Dispatch of responses to webhook destinations you configure.

We may add, change, or remove features as we develop and maintain B2B Forms. We do not guarantee that any particular feature will remain available in its current form.

4. Account registration

  • You must provide accurate, current, and complete information when registering.
  • You are responsible for the security of your account credentials and for all activity that takes place through your account.
  • You must notify us promptly if you believe your account has been accessed without your authorisation.

5. Free and paid plans

B2B Forms is currently provided free of charge. You can create an account, generate forms, and save drafts without making any payment.

We intend to introduce paid plans in the future. When we do, the pricing and features of each plan will be shown clearly before you make any purchase, and paid plans will be governed by additional terms shown at the time of purchase. Any purchase would be processed by a third-party payment provider; we would not store your full payment card details.

Nothing in this section creates any obligation on you to pay for B2B Forms, and nothing obliges us to offer any particular feature free of charge indefinitely.

6. AI form generation

B2B Forms uses a third-party AI language model to generate forms from the business description you provide. This is a powerful tool, but it is not infallible.

  • AI-generated forms may contain errors, omissions, or fields that are not appropriate for your specific business.
  • You are responsible for reviewing any generated form before publishing it. Do not publish a form without checking it.
  • We do not guarantee that generated forms are legally sufficient for any specific purpose. If your form needs to comply with a particular regulatory regime, consult an appropriately qualified professional.
  • Do not include personal information about yourself or others in your business description. See the Privacy Policy for details on how AI generation works.

7. Your responsibilities as a form publisher

When you publish a form, you become responsible for what that form asks and for the responses it collects. Specifically:

  • You are the data controller for any personal data collected through your forms.
  • You must inform respondents how their data will be used, and you must honour any rights they exercise.
  • You must comply with UK GDPR, PECR, and any other applicable laws in the jurisdictions where your respondents are located.
  • You must not use B2B Forms to collect data that you are not entitled to collect, or to mislead respondents about the purpose of the form.
  • You must honour any consent you collect, including the right to withdraw consent.

8. Webhook dispatch and third-party destinations

B2B Forms can dispatch responses to third-party webhook destinations that you configure, such as CRM platforms or lead scoring services.

  • You are responsible for the credentials you provide and for the destinations you choose.
  • Once a response has been transferred to a third-party destination, its handling is governed by that destination's own terms and privacy policy.
  • We are not responsible for the availability, accuracy, or behaviour of third-party destinations.
  • Webhook delivery is retried on certain failures, but we do not guarantee delivery to any destination.

9. Acceptable use

You agree not to use B2B Forms to:

  • Collect, process, or distribute data unlawfully, fraudulently, or in a way that infringes another person's rights.
  • Send unsolicited communications in violation of applicable law.
  • Attempt to reverse-engineer, probe, bypass, interfere with, or disrupt the service.
  • Use bots or automated tools to access the service at scale without our written permission.
  • Misrepresent your identity, your business, or the purpose of a published form.
  • Resell or redistribute the service as a standalone product.

10. Intellectual property

The B2B Forms platform, interface, branding, documentation, and underlying technology are owned by us or our licensors and are protected by applicable intellectual property laws.

You retain ownership of the forms you create and the responses you collect through them. You grant us a limited, non-exclusive licence to host, store, transmit, and process your data only as needed to provide, secure, and maintain the service.

11. Privacy and data protection

Our handling of personal data is described in our Privacy Policy. Please read it alongside these Terms.

12. Disclaimers

B2B Forms is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory.

In particular, and to the fullest extent permitted by law:

  • We do not guarantee that the service will be uninterrupted, error-free, or available at any particular time.
  • We do not guarantee that AI-generated forms will meet your requirements or be legally sufficient for any particular purpose.
  • We do not guarantee that webhook dispatch to any destination will succeed.
  • We are not responsible for the behaviour of any third-party service you connect to B2B Forms.

13. Limitation of liability

To the fullest extent permitted by law, we will not be liable for lost profits, lost revenue, lost data, business interruption, or indirect, incidental, special, consequential, or punitive damages arising from your use of B2B Forms.

Our aggregate liability to you in connection with the service will not exceed the greater of (a) the total amount you have paid to us in the 12 months immediately before the event giving rise to the claim, or (b) £50.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law.

14. Termination

You may stop using B2B Forms at any time and may request deletion of your account by contacting us.

We may suspend or terminate your access if we reasonably believe you have breached these Terms, used the service unlawfully, or placed the security of the service or other users at risk.

Following termination, your access will end and your data will be handled in accordance with our Privacy Policy.

15. Changes to these terms

We may update these Terms to reflect changes to B2B Forms, our business practices, or legal requirements. The revised Terms will appear on this page with an updated date. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.

16. Governing law and contact

These Terms are governed by and interpreted in accordance with the laws of England and Wales. Any dispute arising in connection with these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
